1. Acceptance of Terms
By accessing or using the Saini's Hospitality website, mobile application, or placing an order through any of our brands — Toku, Trisarah, House of Sopranos, and Cater 9(collectively, the “Platform”) — you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Platform.
2. Legal Business Name & Entity Details
The Platform is owned and operated by M/s. SAINI'S HOSPITALITY, trading as “Saini's Hospitality,” registered office at Capital Park Road, VIP Hills, Madhapur, Hitech-City, Hyderabad, Telangana, India.
Saini's Hospitality operates four brands from a central cloud kitchen: Toku, Trisarah, House of Sopranos, and Cater 9.
3. Eligibility
You must be at least 18 years of age to place an order. By ordering, you represent that you meet this requirement and have the legal capacity to enter into a binding contract.
4. Services Description
The Platform allows browsing menus and placing food orders for delivery or takeaway, and requesting corporate/event catering. Items are prepared at our central kitchen in Hyderabad and are subject to availability.
5. Order Placement & Acceptance
An order is an offer to purchase. It is confirmed only once payment is successfully processed and accepted by our kitchen. We reserve the right to reject or cancel an order due to:
- Item unavailability
- Delivery area limitations
- Suspected fraud or abuse
- Operational constraints
A full refund will be issued in such cases.
6. Pricing & Payment
Prices are in Indian Rupees (₹), inclusive of applicable GST unless stated otherwise. We may modify prices without prior notice; the applicable price is the one shown at the time of order placement.
Payments are processed via Paytm and Razorpay. We do not store card, UPI, or banking credentials — all payment data is handled directly by the payment gateway.
7. Delivery
Orders are delivered via third-party logistics partners (Porter, Rapido, or successors). Estimated delivery times are approximate, not guaranteed, and may be affected by traffic, weather, or partner availability.
You are responsible for providing an accurate delivery address and being reasonably available to receive the order.
8. User Obligations
By using the Platform, you agree to:
- Provide accurate, current information
- Use the Platform lawfully and in good faith
- Not misuse, disrupt, or attempt to compromise the Platform
- Inform us of known food allergies before ordering — we cannot guarantee an allergen-free environment across all items
9. Intellectual Property Rights
All content — including the Saini's Hospitality, Toku, Trisarah, House of Sopranos, and Cater 9 names, logos, designs, recipes, descriptions, photographs, and Platform software— is the exclusive property of M/s. SAINI'S HOSPITALITY or its licensors.
No copying, reproduction, distribution, or creation of derivative works is permitted without prior written consent.
10. Limitation of Liability
To the maximum extent permitted by law, Saini's Hospitality is not liable for indirect, incidental, special, or consequential damages, including allergic reactions where allergens were not disclosed prior to ordering.
Total liability for any claim is capped at the amount paid for that specific order.
11. Termination
We may suspend or terminate your access at our discretion, without notice, for suspected fraud, abuse, breach of these Terms, or unlawful activity. You may stop using the Platform at any time.
Termination does not affect rights or obligations accrued prior, including payment obligations for orders already placed.
12. Indemnification
You agree to indemnify and hold harmless Saini's Hospitality, its owners, employees, and partners from any claims, damages, or expenses arising from your breach of these Terms or misuse of the Platform.
13. Force Majeure
We are not liable for failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, government restrictions, strikes, pandemics, or infrastructure outages.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.
15. Dispute Resolution
You agree to first contact sainishospitality@gmail.com to seek an amicable resolution before pursuing any other legal remedies.
16. Amendments
We may revise these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. The “Last Updated” date at the top reflects the latest revision.
